ARTICLE 1: PURPOSE
The purpose of this Policy is to define the rights and obligations of the foundation, the bank, and the donor regarding online donations made through the Hilful Fudul Foundation’s official website, hilfalfudul.org.

- Donors
The natural or legal person who makes a donation to the Hilful Fudul Foundation.
ARTICLE 3: DEFINITIONS
- Site: The website hilfalfudul.org, owned by the Hilful Fudul Foundation.
- Foundation: Hilful Fudul Foundation
- Bank: Wells Fargo, TD Bank
- Donor: The real or legal person who makes the donation.
- E-Card: The online card(s) prepared on the www.hilfalfudul.org website of the Foundation, to be sent to third parties designated by corporate donors within the scope of collective donations they make.
- Personal Data: Any information relating to an identified or identifiable natural person, including but not limited to data of the parties’ employees and individual clients, that is recorded, transferred by one party to the other, or otherwise obtained in any manner within the scope of this Policy.
- Special Categories of Personal Data: Information relating to a person’s race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and clothing, association, foundation or union membership, health, criminal conviction and security measures, as well as biometric and genetic data. (Within the scope of this Policy, the term “Personal Data” shall include “Special Categories of Personal Data” where applicable.)
- Processing of Personal Data: Any operation performed on personal data, whether fully or partially automated or by non-automated means provided that it is part of a data recording system, such as obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, taking over, making accessible, classifying, or preventing the use of such data.
ARTICLE 4: GENERAL PROVISIONS
- All provisions of this policy have been read by the donor and mutually accepted with the foundation.
- This policy enters into force as of the date it is approved online by the donor.
- Within the scope of this policy, the donor may make a donation of any amount to the foundation through the website hilfalfudul.org, using the virtual POS service provided by the bank.
- The donor may withdraw from this policy and request a refund of the donation made to the foundation within 7 days from the date the donation is made online, after accepting this policy as stated in the clause above.
- If the donor wishes to withdraw from the policy and request a refund of the donation, they must notify Hilful Fudul Foundation by sending an e-mail to sekretery@hilfalfudul.org within 7 days from the date of donation. The notification must clearly and explicitly state the refund request, including the date of donation, donation amount, name, and other relevant details. Otherwise, if the withdrawal notice does not reach the foundation’s e-mail address within 7 days, it will be considered invalid, and the refund will not be processed.
- If the donor does not request a refund of the donation within 7 days as stated in the clauses above, they may no longer reclaim or request a refund of the donation under any circumstances — even if the conditions for withdrawal under the relevant provisions of the Code of Obligations are met. This matter has been accepted and acknowledged by the donor without any reservation or ambiguity.
- As stated in the clauses above, the foundation bears no responsibility for donations for which a refund is not requested within 7 days. Similarly, the bank providing the virtual POS service shall also bear no responsibility regarding such donations.
- Within the scope of online donations, the foundation may, at its discretion, create E-Cards through the designated platform and send them to selected recipients. The content and templates of the E-Cards will be determined by the foundation, and the preparation, delivery, and transmission of these E-Cards on behalf of the designated individuals shall be the responsibility of the foundation.
- Neither Party may assign, transfer, sublicense, or subcontract any of its rights or obligations arising from this policy to any third party without the prior written consent of the other Party.
- If any provision of this policy is determined by the relevant authorities or a competent court to be illegal, invalid, or unenforceable, the remaining provisions — except for those deemed essential — shall remain valid and in full force and effect.
- This policy constitutes the entire agreement between the parties regarding the subject matter set forth herein. It shall not be interpreted in favor of or against either party. No amendment or modification of this policy shall be valid unless made in writing and signed by both parties.
- The donor hereby acknowledges and agrees that the Foundation may contact them via mail, email, SMS, or phone call using the address, email address, and phone number provided in the site registration form.
ARTICLE 5: SECURITY
- All information provided by the donor for making a donation through the website shall not, under any circumstances, be shared by the Foundation with any institution, organization, or individual.
- The Foundation may, from time to time, send emails or SMS messages to its members, volunteers, and donors containing information about new projects and activities, as well as greetings and informational messages. If the donor does not wish to receive such communications, they may cancel their subscription by sending a message to the Foundation’s email address at sekreterya@hilfalfudul.org
- The Foundation prioritizes the security of donors who make online donations through the website. Credit card information is never stored in the system. The reliability and security of online donations made via credit card are ensured and audited by the bank with which the Foundation cooperates.
- Donors must never include credit card numbers or passwords in any messages sent to the Foundation’s phone numbers or email addresses regarding any transaction. Information contained in emails may be visible to third parties, and the Foundation cannot guarantee the security of information transmitted via email under any circumstances.
